  • Judge should go, says MP

A FEDERAL MP has called for the resignation of controversial Family Court Chief Justice Alastair Nicholson.

The bold call was made by Victorian Liberal MP Chris Pearce, who claims the judge has tried to interfere in the outcome of a Parliamentary inquiry into child custody.

"It is Justice Nicholson's role to administer the law, not make it," Mr Pearce said last night.

Justice Nicholson is due to retire in March, but Mr Pearce said his recent comments made it imperative the judge resigned now. In a series of articles on the problems of the Family Court, the Herald Sun recently revealed how some fathers had been forced to bypass the court to see their children.

Some even resorted to paying their ex-wives tens of thousands of dollars just to see their children.

But Justice Nicholson responded by warning the House of Representatives committee against recommending any changes to the court's child custody powers.
